These Terms of Service (“Terms”) govern your access to and use of the Commray website, applications, APIs, dashboards, monitoring tools, log management services, and related services (collectively, the “Services”).
By accessing or using Commray, you agree to be bound by these Terms.
If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.
1. Overview of Services
Commray provides cloud-based monitoring, observability, dashboarding, alerting, and log management services for individuals, teams, and organizations.
Features and limits may vary depending on the subscription plan selected.
2. Accounts and Workspace Responsibility
To use certain features, you must create an account.
You are responsible for:
- Maintaining the confidentiality of account credentials
- Managing user access within your workspace
- Activities that occur under your account or workspace
- Ensuring authorized use of the Services
Commray may suspend or terminate accounts that violate these Terms.
3. Free Trial
Commray may provide a free trial period for paid plans.
Unless otherwise stated:
- Trials are limited to 14 days
- Trial access may include features from paid plans
- A payment method may be required for continued use after the trial
- Commray reserves the right to modify or terminate trial offerings at any time
After the trial ends, accounts may be downgraded, restricted, or suspended until a paid subscription is activated.
4. Subscription Plans and Billing
Commray offers multiple subscription plans, including Free Tier, Starter, Team, Growth / Pro, and Enterprise plans.
Plan limits may include:
- User count
- Daily or monthly log ingestion
- Data retention periods
- Feature access
- API access
- Integrations
- Security and compliance features
Pricing and limits may change periodically.
5. Usage-Based Billing
Certain plans may include usage-based charges in addition to the base subscription fee.
Additional charges may apply for:
- Log ingestion over plan limits
- Additional storage
- Premium features
- Enterprise services
Customers are responsible for monitoring their usage and associated costs.
6. Payments
Payments are processed through third-party payment providers.
By subscribing to a paid plan, you authorize Commray and its payment providers to charge applicable fees using your selected payment method.
Unless otherwise stated:
- Subscription fees are billed in advance
- Fees are non-refundable
- Failure to pay may result in suspension or termination of Services
7. Acceptable Use
You agree not to:
- Use the Services for unlawful activities
- Attempt unauthorized access to systems or accounts
- Interfere with platform stability or security
- Upload malicious code or harmful content
- Abuse ingestion endpoints or infrastructure
- Use the Services to violate privacy or intellectual property rights
Commray reserves the right to suspend accounts involved in abusive or harmful behavior.
8. Customer Data
Customers retain ownership of Customer Data submitted to the Services.
You grant Commray a limited right to process Customer Data solely for the purpose of operating and improving the Services.
Customers are responsible for ensuring that submitted data complies with applicable laws and regulations.
9. Data Retention
Data retention periods vary by subscription plan or customer configuration.
Commray may delete data that exceeds applicable retention periods or storage limits.
10. Service Availability
Commray strives to provide reliable Services but does not guarantee uninterrupted or error-free operation.
Scheduled maintenance, infrastructure failures, security incidents, or third-party provider outages may affect availability.
11. Security
Commray implements reasonable technical and organizational safeguards designed to protect customer information and infrastructure.
Customers remain responsible for:
- Managing account credentials
- Configuring access permissions
- Securing systems connected to the Services
12. Intellectual Property
The Services, software, branding, logos, and related materials are the property of Commray and its licensors.
These Terms do not grant ownership rights to customers except as explicitly stated.
13. Third-Party Services
Commray may integrate with third-party platforms or providers.
Commray is not responsible for the availability, content, or practices of third-party services.
14. Limitation of Liability
To the maximum extent permitted by law, Commray shall not be liable for:
- Indirect or consequential damages
- Data loss
- Business interruption
- Lost profits or revenue
- Security incidents beyond reasonable control
Commray’s total liability shall not exceed the amount paid by the customer to Commray during the twelve months preceding the claim.
15. Termination
Customers may cancel subscriptions at any time.
Commray may suspend or terminate Services for:
- Violations of these Terms
- Non-payment
- Security risks
- Abuse of the platform
Certain provisions of these Terms survive termination, including payment obligations and limitation of liability.
16. Changes to the Services or Terms
Commray may modify the Services, pricing, plans, or these Terms at any time.
Updated Terms will be posted on this page with a revised effective date.
17. Governing Law
These Terms shall be governed by and interpreted in accordance with applicable laws in the jurisdiction where Commray operates, without regard to conflict of law principles.
